Consulate of Spain in Kiev explained their refusal to register children born in Ukraine with the help of surrogate motherhood: changing the policy of protecting personal data in European legislation.
The procedure for establishing the relationship between the child and biological parents required DNA analysis when one of the consular staff personally took the sample and sent it to a laboratory in Spain. After confirming the relationship, a Spanish passport is to be issued for the child for crossing the border and being at home land parents passed the adoption procedure.
After the recent changes in European legislation, parents now cannot cross the border with the newborn. Consulate staff can no longer collect himself DNA samples and send them to a Spanish laboratory and at the same time, Spanish authorities do not recognize DNA results made outside the European Union. Official representatives of Madrid warned compatriots that they might have problems if they decide to seek help from one of the Ukrainian clinics.
The decision about this ban was final after another scandal with the IVF clinic “BioTechCom”, the largest company providing surrogate motherhood services in Ukraine. Recall that according to police, “BioTechCom” is engaged in trafficking in human beings and forgery of documents.
The Spanish Foreign Ministry noted that the embassy will deal with each case individually. However, this can take a large amount of time, so that the Spanish could return to their homeland with their child.
